Здравствуйте, есть ру фарма шоп, зона .ru существует довольно давно.
Недавно получил письмо от envisional.com о нарушении прав сиалиса.
Какие могут быть последствия, что предпринять?

"Dear Sir or Madam:
Our company represents Eli Lilly and Company, owner of the Cialis(R) (tadalafil) prescription pharmaceutical product for the treatment of erectile dysfunction, with respect to protecting and enforcing Lilly's intellectual property rights related to Cialis (hereinafter "Lilly Rights"). This letter is to provide you with notice of violation of the Lilly Rights, specifically the unlawful false advertising and sale of counterfeit, "generic" and/or "soft" Cialis(R) tablets on your website, happymen.ru (hereinafter, the "Website").
Lilly has invested substantial amounts of time and money in developing and maintaining goodwill in its products and services, and Lilly's Rights are of enormous value. Since its introduction in 2003, the Cialis(R) brand has become a widely used treatment for erectile dysfunction, with more than 25 million Cialis(R) brand tablets prescribed around the world. Available only on a physician's prescription, Cialis(R) brand tablets have been approved by the U.S. Food and Drug Administration (FDA), European Medicines Agency (EMEA), and national health authorities in over 50 countries. It is manufactured, labeled and monitored in strict compliance with the laws and regulations of those health authorities. No other forms of the active ingredient in Cialis(R) tablets, tadalafil, have been approved for sale in the U.S., Europe, Canada, or to our knowledge, any other country.
To protect its substantial investment in this highly popular drug, Lilly has acquired patents, trademarks, copyrights, and other rights under U.S. and international law. For example, the tadalafil compound and method of use are protected under international patent laws. The CIALIS(R) trademark, "swirl" logo and the appearance of the Cialis(R) tablet, which have become famous around the world as a result of the enormous media exposure for this popular product, are protected under U.S. Trademark Reg. Nos. 2,724,589, 2,833,221 and 2,833,222. The unique packaging for the Cialis(R) product, which includes the swirl logo, is protected under U.S. Copyright Reg. No. TX-5-713-466.
It is our understanding that you are infringing upon Lilly's Rights by unlawfully displaying, advertising, offering for sale and selling counterfeit, "generic" and/or "soft" Cialis(R) tablets, and possibly other products containing tadalafil (other than authentic Cialis(R)), on the Website without authorization from Lilly. Such unauthorized use and offering for sale of counterfeit and/or illegal unapproved Cialis(R) tablets violates federal and state trademark laws, including the Lanham Act, 15 U.S.C. Section 1114 et seq., and constitutes false advertising in violation of federal and state unfair competition laws.
Moreover, because the FDA has not approved the sale of "generic" or "soft" Cialis(R) or other products containing tadalafil in the United States, the sale and/or import of such unauthorized tablets in the United States also violates the Federal Food, Drug and Cosmetic Act, 21 U.S.C. Section 301 et seq., 21 U.S.C. Section 355 (unapproved drug) and/or 21 U.S.C. Section 352 (improper or unapproved labeling). In addition, on June 13, 2006, the U.S. International Trade Commission issued a General Exclusion Order under 19 U.S.C. Section 1337(G)(2) prohibiting the unlicensed importation into the United States of tadalafil or any salt or solvate thereof, and products containing same, covered by one or more claims 1-4, 6-8, 12 and 13 of '006 patent.
If found liable by a court of law, you may be ordered to pay damages to Lilly or other related parties, including reasonable attorneys' fees and costs, and be subject to an injunction.
Without limitation, a representative sample of your infringing acts may be found at the following URL locations:

Lilly takes reports of infringement very seriously and will not hesitate to pursue all available legal remedies. Your potential liability in this matter, should it be litigated, is significant.
Nevertheless, we believe it to be in the best interest of all parties involved to resolve this matter amicably and outside of the courtroom. Therefore, we demand that you:
(1) Immediately cease and desist from displaying, advertising, offering for sale and selling counterfeit, "generic" and/or "soft" Cialis(R) tablets and any other products containing tadalafil on the Website or any other websites you own or operate; and
(2) Immediately remove all uses of Lilly's CIALIS trademark and appearance of the Cialis tablet from the Website.
If you fail to immediately comply with the foregoing demands, Lilly reserves the right to take all appropriate action against you without delay and with no further notice, including but not limited to the filing of a lawsuit. This letter is not a complete statement of Lilly's rights in connection with this matter, and nothing contained herein constitutes an express or implied waiver of any rights, remedies, or defenses of Lilly in connection with this matter, including referral to appropriate law enforcement authorities, all of which are expressly reserved." |

могут отобрать домен (засуспендить через абузу регистратору)

переименуй generic cialis (генерик cialis) в tadalafil (тадалафил) и всё
раз шоп под ру - можно дописать прям в титле про то что «это аналог всемирно известного циалиса» - они трекают английское слово «cialis» , но не русское «циалис»
как только сделаешь - сразу отпишись им в обратку, что мол всё готово, бренд cialis с сайта убран
если была картика с текстом cialis - лучше впрозапас замени её тоже на просто жёлтую без текста
урл site.ru/cialis сначала оставь - сделай так что б там выдавался текст из серии product restricted
через пару недель - поставь редирект cialis на tadalafil например, айдишник продукта смени - это обязательно.
вообщем цель замута - что б нигде слово cialis не фигурировало.

это легко проверяется по хедерам у письма - надо глянуть тех-инфу откуда письмо родом (а не только реплай-ту) и сразу всё станет на свои места. |
